1. Professional Status & Regulations
1.1 Heres Law is currently in the application process for membership with the Institute of Professional Willwriters (IPW).
1.2 We voluntarily comply with the IPW Code of Practice, which is approved by the Chartered Trading Standards Institute (CTSI). A copy of the Code is available at www.ipw.org.uk.
1.3 We maintain Professional Indemnity Insurance in the sum of minimum of £2 million. While our membership is pending, this insurance is maintained in accordance with standard professional requirements for estate planning practitioners.
2. Our Obligations
2.1 We will provide advice with reasonable skill and care.
2.2 We will provide first drafts of your documents within 5-10 working days of receipt of full instructions. During periods of high demand, this may extend to 10-15 working days. We will notify you of any such delay.
2.3 We will maintain the strictest confidentiality. We will not disclose your information to any third party without your consent, unless required by law.
3. Fees, Payments & Duration of Service
3.1 Fixed Fees: All fees are fixed as per the “Summary of Instructions” email sent following your consultation. Heres Law is currently awaiting VAT registration; therefore, the fixed fee quoted is the total amount payable and is inclusive of any applicable taxes.
3.2 Payment Terms: We operate a “Draft First” policy. We will complete your draft documents within 5–10 working days of your instruction. An invoice will be issued upon completion of the drafts. Full payment is required before the draft documents are released to you for review.
3.3 Duration of Service: The fixed fee covers the drafting and finalisation of your documents for a maximum period of 12 months from the date of your initial instruction. If the matter is not finalised within this timeframe due to client delay, Heres Law reserves the right to close the file or apply an additional administration fee to resume work.
3.4 Third-Party Fees (Disbursements): Our fees cover legal drafting and professional advice only. They exclude external costs such as Office of the Public Guardian (OPG) registration fees (currently £92 per document) or Land Registry fees.
4. Client Obligations & Accuracy
4.1 You must provide full and accurate information regarding your assets, family, and wishes.
4.2 We accept no liability for any loss or invalidity caused by your failure to disclose material facts.
5. Execution & Validity (The “Self-Execution” Clause)
5.1 We provide a drafting-only service. We do not supervise the signing (attestation) of the documents in person.
5.2 The legal validity of the documents depends entirely on them being signed and witnessed in accordance with the Wills Act 1837. We accept no liability for documents executed incorrectly.
6. Cancellation Rights
6.1 You have the right to cancel this contract within 14 days without giving a reason.
6.2 Waiver to Start Work: If you request in writing (via our email confirmation process) that we start work immediately, you acknowledge that you waive your 14-day cancellation right once the service has been fully performed (i.e., drafts completed).
7. Complaints & Dispute Resolution
7.1 If you have a complaint, please contact Charlotte Warren at cwa@hereslaw.co.uk.
7.2 We will acknowledge your complaint within 5 working days and provide a full written response within 28 days.
7.3 Independent Redress: As our IPW membership is currently pending, the IPW Alternative Dispute Resolution (ADR) service may not yet be available for disputes. However, we are committed to resolving all matters fairly and in accordance with the standards of the IPW Code of Practice.
8. Limitation of Liability
8.1 Our total liability in respect of any claim arising out of this agreement is limited to the amount of our Professional Indemnity Insurance.
9. Data Protection
9.1 We process data in accordance with the UK GDPR and the Data Protection Act 2018.
9.2 Data Controller: Heres Law is registered with the Information Commissioner’s Office (ICO) under registration number ZC095769.
9.3 Purpose of Processing: Data is collected to verify identity (AML), provide legal drafting, and ensure future compliance with IPW standards.
